Deutsch – Allgemeine Geschäftsbedingungen (AGB) der Luciano Cimmarrusti GmbH

1. Geltungsbereich
Diese AGB gelten für sämtliche Leistungen der Luciano Cimmarrusti GmbH, die über Online-Buchungen oder per WhatsApp vereinbart werden.

2. Terminvereinbarungen
Termine können ausschließlich online oder via WhatsApp gebucht werden. Telefonate werden nicht entgegengenommen – wir rufen nur dann zurück, wenn Sie uns eine Voicemail hinterlassen und ein telefonisches Gespräch unbedingt erforderlich ist. Andernfalls erfolgt die Kommunikation ausschließlich über WhatsApp. Wir legen großen Wert auf Pünktlichkeit und erwarten, dass auch unsere Kunden rechtzeitig erscheinen. Bei einer Verspätung von mehr als 15 Minuten ohne vorherige Mitteilung behalten wir uns das Recht vor, den Termin zu stornieren oder zu verschieben. Termine sind persönlich und nicht übertragbar – auch nicht innerhalb der Familie.

3. Nichterscheinen und Stornierung
Sollten Sie ohne rechtzeitige Absage (mindestens 48 Stunden vor dem Termin) nicht erscheinen oder den Termin nicht umplanen, wird der volle Preis des vereinbarten Services in Rechnung gestellt. Diese Regelung dient dazu, unsere Kapazitäten effizient zu planen und anderen Kunden die Nutzung des freigewordenen Termins zu ermöglichen.

4. Preise und Zahlungsbedingungen
Unsere Preise verstehen sich als verbindlich und richten sich nach Art und Umfang der gewünschten Leistung. Alle Preise verstehen sich inklusive der gesetzlichen Mehrwertsteuer. Wir behalten uns das Recht vor, unsere Preise jederzeit ohne vorherige Ankündigung anzupassen. Rabatte oder Sonderangebote gelten nicht für Gutscheine, Haarverlängerungen oder sonstige Produkte, sondern ausschließlich für die in Anspruch genommenen Dienstleistungen. Die Zahlung erfolgt unmittelbar nach Abschluss der Leistung. Wir akzeptieren Barzahlung sowie die gängigen Kredit- und Debitkarten.

5. Warteliste
Sollte kurzfristig ein Termin frei werden, bieten wir unseren Kunden die Möglichkeit, sich in eine Warteliste einzutragen – entweder über unser Online-Formular oder via WhatsApp. Die Eintragung in die Warteliste stellt jedoch keine Garantie für die Vergabe eines Termins dar.

6. Haftung und Allergiehinweis
Die Luciano Cimmarrusti GmbH haftet nicht für Schäden an Eigentum oder für Verletzungen, die durch unsachgemäße Handhabung von Werkzeugen oder Produkten durch den Kunden entstehen.
Der Kunde ist verpflichtet, uns vor der Behandlung über bestehende Allergien, Unverträglichkeiten oder gesundheitliche Vorbedingungen zu informieren. Kommt es zu allergischen Reaktionen oder unerwünschten Ergebnissen, so haften wir nur bei nachweislicher grober Fahrlässigkeit oder Vorsatz. Ferner übernehmen wir keine Haftung für ästhetische Ergebnisse, sofern diese nicht im Vorfeld eindeutig besprochen wurden.

7. Datenschutz
Alle von uns erhobenen Kundendaten werden streng vertraulich behandelt und ausschließlich zu internen Zwecken zur Verbesserung unseres Services verwendet. Eine Weitergabe an Dritte erfolgt nicht ohne Ihr ausdrückliches Einverständnis.

8. Social Media und Veröffentlichung von Inhalten
Im Rahmen unserer Leistungen können Fotos und Videos zu Promotionszwecken aufgenommen werden. Mit Ihrer Zustimmung zur Veröffentlichung räumen Sie der Luciano Cimmarrusti GmbH ein unwiderrufliches Nutzungsrecht an Ihrem Bild- und Videomaterial ein – auf sämtlichen Social-Media-Kanälen sowie in weiteren Werbematerialien. Mit der Erteilung dieser Zustimmung verzichten Sie ausdrücklich auf Ihr Recht, zu einem späteren Zeitpunkt die Löschung oder den Widerruf der Veröffentlichung zu verlangen.

9. Sonstige Bestimmungen
a. Salvatorische Klausel: Sollte eine Bestimmung dieser AGB unwirksam oder undurchführbar sein, bleiben die übrigen Regelungen unberührt.
b. Änderungen der AGB: Wir behalten uns das Recht vor, diese AGB jederzeit zu ändern. Die jeweils aktuelle Version wird auf unserer Website veröffentlicht.
c. Gerichtsstand und anwendbares Recht: Es gilt das Recht der Schweiz. Ausschließlicher Gerichtsstand ist Zürich, Schweiz.
d. Force Majeure: Für Verzögerungen oder Ausfälle, die durch Umstände außerhalb unserer Kontrolle (höhere Gewalt) entstehen, haften wir nicht.

English – Terms and Conditions of Luciano Cimmarrusti GmbH

1. Scope
These Terms and Conditions apply to all services provided by Luciano Cimmarrusti GmbH (the Salon) when appointments are booked online or via WhatsApp.

2. Appointment Bookings
Appointments can be booked exclusively online or via WhatsApp. We do not accept phone calls; we will only return a call if you leave a voice message and a telephone discussion is absolutely necessary. Otherwise, all communication will be conducted via WhatsApp. We strive for punctuality and expect our clients to be on time. If you are more than 15 minutes late without prior notice, we reserve the right to cancel or reschedule your appointment. Appointments are personal and non-transferable.

3. No-Show and Cancellation Policy
If you fail to appear without giving notice at least 48 hours in advance, or if you do not reschedule your appointment in time, the full fee for the scheduled service will be charged. This policy ensures efficient planning and allows other clients the opportunity to use the available slot.

4. Prices and Payment Terms
Our prices are fixed and depend on the type and scope of the service provided. All prices include the statutory VAT. We reserve the right to adjust our prices at any time without prior notice. Discounts or special offers do not apply to gift vouchers, hair extensions, or other products—they apply solely to the services rendered. Payment is due immediately after the service is completed. We accept cash as well as all major credit and debit cards.

5. Waitlist
We offer a waitlist for appointments that become available on short notice. Clients can register for the waitlist via our online form or through WhatsApp. Please note that being on the waitlist does not guarantee an appointment.

6. Liability and Allergy Notice
The Salon is not liable for any damage to property or injuries resulting from the improper handling or use of tools and products by the client.
It is the client’s responsibility to inform us of any allergies, intolerances, or pre-existing conditions relevant to the service prior to treatment. We shall not be held liable for allergic reactions or adverse outcomes unless due to gross negligence or intentional misconduct. We also disclaim any liability for aesthetic dissatisfaction if the outcome has not been clearly agreed upon in advance.

7. Data Protection
All client data is handled confidentially and used solely for internal purposes to enhance our services. Personal data will not be shared with third parties without the client’s explicit consent.

8. Social Media and Content Publication
During your visit, photographs and videos may be taken for promotional purposes. By consenting to the publication of your image and likeness, you grant Luciano Cimmarrusti GmbH an irrevocable right to use such content on its social media channels and in other marketing materials. Once this consent is given, you waive any right to request the deletion or removal of the published content at a later date.

9. Miscellaneous
a. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
b. Amendments: We reserve the right to amend these Terms and Conditions at any time. The current version will be published on our website.
c. Governing Law and Jurisdiction: These Terms and Conditions are governed by Swiss law. The exclusive place of jurisdiction is Zurich, Switzerland.
d. Force Majeure: We are not liable for delays or failures in performance resulting from circumstances beyond our control.

1. Champ d’application
Les présentes Conditions Générales s’appliquent à l’ensemble des services fournis par Luciano Cimmarrusti GmbH (le Salon) lors de la prise de rendez-vous exclusivement en ligne ou via WhatsApp.

2. Prise de Rendez-vous
Les rendez-vous ne peuvent être pris que via le site internet ou par WhatsApp. Les appels téléphoniques ne sont pas acceptés ; nous ne rappelons que si vous laissez un message vocal et qu’un échange téléphonique s’avère indispensable. Dans le cas contraire, toute communication s’effectuera par WhatsApp. Nous nous engageons à être ponctuels et attendons la même rigueur de la part de nos clientes. En cas de retard de plus de 15 minutes sans notification préalable, nous nous réservons le droit d’annuler ou de reporter le rendez-vous. Les rendez-vous sont strictement personnels et non transférables, même au sein de la famille.

3. Absence et Politique d’Annulation
En cas de non-présentation ou d’annulation sans préavis d’au moins 48 heures, le montant total du service réservé sera facturé. Cette mesure vise à garantir une planification efficace et à offrir la possibilité à d’autres clientes de bénéficier du créneau libéré.

4. Tarifs et Modalités de Paiement
Nos tarifs sont fermes et dépendent du type et de l’ampleur de la prestation demandée. Tous les prix incluent la TVA en vigueur. Nous nous réservons le droit de modifier nos tarifs à tout moment sans préavis. Les remises ou offres spéciales ne s’appliquent pas à l’achat de bons cadeaux, extensions de cheveux ou autres produits, mais uniquement aux services. Le paiement est exigible immédiatement après la prestation. Nous acceptons les paiements en espèces ainsi que les principales cartes de crédit et de débit.

5. Liste d’Attente
En cas d’annulation de dernière minute, nous proposons une liste d’attente. Les clientes peuvent s’inscrire à cette liste par le biais de notre formulaire en ligne ou via WhatsApp. Notez que l’inscription à la liste d’attente ne garantit pas l’obtention d’un rendez-vous.

6. Responsabilité et Avis Allergique
Le Salon décline toute responsabilité en cas de dommages matériels ou corporels résultant d’une utilisation inappropriée des outils ou produits par la cliente.
Il incombe à la cliente de nous informer, avant toute prestation, de toute allergie, intolérance ou condition préexistante pouvant affecter le service. Le Salon ne pourra être tenu responsable des réactions allergiques ou des conséquences indésirables, sauf en cas de négligence grave ou de faute intentionnelle. Nous déclinons également toute responsabilité en cas d’insatisfaction esthétique, sauf accord préalable sur les résultats attendus.

7. Protection des Données
Les données personnelles de nos clientes sont traitées de manière strictement confidentielle et utilisées uniquement à des fins internes d’amélioration de nos services. Aucune information personnelle ne sera communiquée à des tiers sans le consentement explicite de la cliente.

8. Réseaux Sociaux et Publication de Contenus
Lors de votre visite, des photos et vidéos peuvent être prises à des fins promotionnelles. En donnant votre consentement à la publication de votre image, vous accordez à Luciano Cimmarrusti GmbH un droit irrévocable d’utiliser ces contenus sur ses réseaux sociaux et dans d’autres supports publicitaires. Une fois ce consentement donné, vous renoncez expressément à tout droit de demander ultérieurement la suppression ou le retrait de ces contenus.

9. Dispositions Diverses
a. Clause de Séparabilité : Si une disposition des présentes Conditions Générales est jugée invalide ou inapplicable, les autres dispositions resteront pleinement en vigueur.
b. Modifications : Nous nous réservons le droit de modifier ces Conditions Générales à tout moment. La version la plus récente sera publiée sur notre site internet.
c. Loi Applicable et Juridiction : Les présentes Conditions Générales sont régies par le droit suisse. La juridiction exclusive est fixée à Zurich, Suisse.
d. Force Majeure : Le Salon ne pourra être tenu responsable des retards ou manquements dans l’exécution dus à des circonstances indépendantes de notre volonté.
